Streaming Policy

StudioMDHR Entertainment Inc. (“Studio MDHR”, “we”, “us” or “our”) intensely supports the efforts of its community members who produce community videos, such as “Let’s Play”, “Walkthrough”, “Preview” and/or “Commentary” videos and streams (collectively, “Community Content”) using video footage, images, artwork, screenshots, in-game audio, music or other media assets from Studio MDHR’s games and merchandise (collectively, the “Studio MDHR Products”). Community Content includes ad-supported and monetized channels/videos, as well as recorded gameplay used on live or recorded television broadcasts.
Within reason, you are allowed to make Community Content such as videos of the gameplay of Studio MDHR Products and distribute them. While your Community Content cannot be sold, you are allowed to monetize such Community Content through advertising. For example, this means that you can make Let’s Plays on YouTube or stream yourself on Twitch, but you may not sell any individual pieces of Community Content that you make.
We understand that a lot of content creators solicit donations on platforms such as Patreon or Twitch. You may accept donations in connection with your Community Content generally, but they may not be tied to the delivery of a specific piece of Community Content. You must not try to push, force or pressure your fans to donate to you in any way. Your request for donations must be unobtrusive.
If your Community Content contains “spoilers” of the story of any Studio MDHR Product, your Community Content must contain an appropriate “spoiler warning” either at the beginning of your Community Content (if your Community Content contains spoilers throughout) or at the beginning of a segment of your Community Content (if the spoilers are contained within a segment of your Community Content).
Your Community Content cannot:
- state or imply that your Community Content is endorsed or created by us;
- contain links to websites or services that promote piracy or hacks of the any Studio MDHR Product, or any other software;
- harass, abuse, defame, attack, or bully any individual;
- damage the reputation and goodwill of Studio MDHR or the Studio MDHR Products;
- infringe any third-party intellectual property rights, personality rights, or other third-party rights;
- make false or misleading claims about Studio MDHR Products;
- otherwise breach any applicable laws.
You may create Community Content only as long as you comply with his Policy. Studio MDHR, in its sole discretion, can revoke or limit your permission to create Community Content at any time. Nothing in this Video and Streaming Policy (this “Policy”) should be construed as providing you with any exception or rights to stream Studio MDHR Products beyond as permitted by Studio MDHR.

Use of the Cuphead Soundtrack
Studio MDHR may, in its sole discretion, choose to make available certain sound recordings and the musical works embodied in those sound recordings for “Cuphead” and all its expansions and updates (the “Cuphead Soundtrack”). Use of the Cuphead Soundtrack outside of captured gameplay is prohibited without the prior written consent of Studio MDHR.
Please note that Studio MDHR has officially partnered with Create Music Group, a Digital Rights Management Company, to act as our Agent in making copyright claims.
Questions have been raised about the use of copyright claims on YouTube (and other third-party websites) in regards to the Cuphead Soundtrack. It has always been our policy to foster an open dialogue about use of the Cuphead Soundtrack. Often, this dialogue takes the form of digital content: audio, visual, or audiovisual media uploaded to YouTube and viewed there; or hosted/embedded there and viewed on another platform.
As such, it is the policy of Studio MDHR to not establish copyright claims on content which is primarily focused on reviews, walkthroughs, Let’s Plays, previews, or commentaries. Similarly, we will not establish claims on uses of the trailer (in its entirety). Our focus has been, and claims will be made, on other uses of soundtrack such as (by way of example but not limited to) unauthorized soundtrack streams or content not about Cuphead that uses the soundtrack for background music. In these uses, claims may be made.
In order to assure that this Policy is followed strictly, as well as ensuring that we comply with all other YouTube policies, we have contracted with an experienced Digital Rights Management Company to act as our Agent in making copyright claims. Any claims for the Cuphead Soundtrack will be made by our agent: Create Music Group.
